                 On July 12, the German-china Trade & Arbitration Day was jointly ARBITRATION by the China International Economic and Trade Commission (CIETAC) and the German court of ARBITRATION (Dis) in Berlin, Germany, and at the meeting signed an updated cooperation agreement. Embassy officials, representatives of the German Chamber of Commerce in China and more than 50 legal officers, lawyers and scholars from German and Chinese enterprises in Berlin, Bonn, Munich, Frankfurt and other cities attended the meeting. China Central Radio and television, People's daily, China News Service and other media covered the seminar extensively.

    Zhai Qian, Minister of the Chinese embassy in Germany, Wang Chengjie, deputy director-general and secretary-general of the International Trade and Arbitration Commission, and Ramona Schardt, secretary-general of the German court of Arbitration delivered opening remarks. A keynote speech and a round-table discussion were held at the seminar, during which more than 10 Sino-german arbitration experts conducted in-depth discussions on the frontier issues in the field of international arbitration, including trade dispute settlement, procedural efficiency and arbitral awards.

Minister Zhai Qian delivered a speech

    

    In his speech, Minister Zhai said that this year marks the 10th anniversary of the establishment of china-germany comprehensive strategic partnership, and the two sides enjoy very active exchanges at all levels and in all fields. Although china-germany and china-eu cooperation is facing multiple challenges, there are broad prospects for bilateral cooperation. Trade arbitration is the most representative arbitration institution in China, and the German court of Arbitration is also the most influential arbitration institution in Germany. Under the current complicated international situation, this seminar is of positive and practical significance to promote sino-german economic and trade cooperation.

 

Speech by secretary-general Wang Chengjie

      In his speech, secretary-general Wang Chengjie said that arbitration, as a common means of settling international trade and investment disputes, plays an indispensable role in handling international commercial disputes and maintaining international economic and trade stability. As the earliest foreign-related arbitration institution in China, trade arbitration has always been committed to working with global partners to promote arbitration and other multi-dispute resolution methods worldwide. Secretary-general Wang Chengjie recommended that sino-german arbitration institutions optimize their cooperation model and achieve more practical results; deepen scientific and technological support and promote the intelligent development of international arbitration; and integrate resource advantages, to help enterprises enhance their ability to prevent legal risks; to jointly promote exchanges between the arbitration legal circles of China, Germany and china-eu, and to contribute to bilateral and multilateral economic and trade cooperation.

      In her speech, secretary-general Ramona Schardt said that the German court of Arbitration and the Arbitration Commission attached great importance to strengthening cooperation and had reached a number of consensus in jointly promoting sino-german Economic and trade cooperation and promoting the development of dispute settlement. In the future, the two institutions will work together to enhance the understanding of arbitration among sino-german commercial entities and promote the development of international arbitration through more practical cooperation.

     At the seminar, the Arbitration Commission and the German Court of Arbitration signed an updated cooperation agreement in the presence of Minister Zhai Qian and representatives present at the meeting. Founded in 1947, the German Court of Arbitration is the largest arbitration institution in Germany and one of the largest in Europe. In the 30 years since the signing of the cooperation agreement, the two sides have conducted fruitful and diversified exchanges and cooperation on international commercial arbitration. This renewal of the cooperation agreement is to further strengthen cooperation under the new situation and promote the development of arbitration and escort between China and Germany, as well as the international economy and trade, we will jointly promote the integrated development of international arbitration through broader and deeper cooperation in jointly promoting the arbitration system, organizing arbitration activities, recommending arbitrators and conducting research

Secretary-general Wang Chengjie delivered a keynote speech

    At the seminar, secretary-general Wang Chengjie delivered a keynote speech on the theme of“New rules and practical development of the trade fair”. He introduced the latest achievements of the international development, including the leading arbitration rules, the professional international team of Arbitrators, diversified dispute resolution services, the layout of global institutions, the construction of information and intelligence, and international exchanges and cooperation. Combined with the highlights of the new edition of the arbitration rules, secretary-general Wang Chengjie focused on interpreting the relevant provisions of the new rules in respect of party autonomy, enhancing arbitration efficiency, achieving the integration and development of common law and civil law systems, meeting the diverse dispute resolution needs of parties, enhancing the level of digital and intelligent arbitration, and further enhancing the transparency of arbitration procedures, and share the rich dispute settlement practice of the Trade Center.

President Heiko Heppner delivered the keynote address

      Heiko Heppner, chairman of the China Committee of the German Court of Arbitration and managing partner of the European arbitration practice of Dentons, delivered a keynote speech on the topic of“The constructive role of arbitration institutions in trade disputes”. Noting that international arbitration was an important means of settling economic and trade disputes between commercial subjects and that it was important to strike a balance between efficiency, fairness and cost in arbitration cases, it is in the real interests of the parties to properly settle disputes in arbitration proceedings by means of mediation. It is hoped that the arbitration community between China and Germany will strengthen exchanges and jointly explore and promote the development of multi-dispute mechanisms, including arbitration.

In the round-table discussion, experts at home and abroad made in-depth discussion around the current development of international arbitration hot issues. Under the theme of“Trade dispute settlement”, Joachim Glatter, a member of the Chinese committee of the German Court of Arbitration and a senior arbitrator of the International Trade Arbitration Commission, presided over the discussion. Stefan KR öll, president of the German Court of arbitration, Yang Fan, director-general of the Intellectual Property Dispute Resolution Office of the Arbitration Commission, and Zhao Hang, senior arbitrator of the Arbitration Commission and senior consultant of the trade and commerce law firm, were the panellists, this paper analyzes the advantages of arbitration over litigation in the settlement of international trade disputes, and combined with practical cases, puts forward some pertinent suggestions on the related matters that the parties should pay attention to in the process of drafting arbitration clauses

      The seminar on “Procedural efficiency and enforcement of arbitral awards” was moderated by Lin Miao, member of the Chinese Committee of the German Court of Arbitration and President of ACT Carbon Fiber Applications Technologies Ltd. . Heiko Heppner, chairman of the China Committee of the German Court of Arbitration; Jia Shen, secretary-general of the Shanghai branch of the International Trade Arbitration Commission; and Christopher B öhringer, general counsel of well-known German wineries, were the guests of the seminar, on how to better balance efficiency and fairness in the process management of arbitration cases, and how to improve efficiency by making use of such means as the process management conference, and how arbitration institutions and arbitrators can better guarantee the extraterritorial enforcement of arbitral awards.

     The meeting concluded successfully with warm discussions and mutual learning. It was generally agreed that the seminar would contribute to a better understanding of the sino-german legal regime on arbitration, in particular the highlights of the new edition of the arbitration rules for Trade and arbitration, and promote exchanges and cooperation in sino-german arbitration law, undoubtedly, it will play a positive role in promoting the stable and orderly development of international economy and trade.
